What Employers Must Know About The EEOC's 2024 Updated Harassment Guidance
Summary: On April 29, 2024, the EEOC published updated enforcement guidance on harassment in the workplace. This is the EEOC's first published guidance on harassment in 25 years. The guidance includes expanding the covered bases such that claims may now be based on traits or characteristics such as the employee's name, dress, accent or manner of speech, and physical characteristics, including appearance standards (e.g., hair textures and hairstyles). A harassment claim may now also be premised on negative perceptions about older workers (e.g., less tech saavy) or disabled individuals (how an individual speaks, looks or moves). Also learn about new categories of harassment, conduct forming bases of harassment claims (e.g., misgendering), and modern workforce considerations (e.g., harassment in remote and online work). Join us for a presentation regarding the updated guidance and what employers should do in response.
